There are several ways to challenge a beneficiary designation. The first thing that we look at is whether the person had capacity when they made the designation. There are people who have Alzheimer's, dementia, or even as far as being on a respirator in hospice that do not have the mental wherewithal in order to change a beneficiary designation through their insurance company. The other way to challenge is through undue influence. That is if somebody is pushing their agenda so much on the person making the designation that they can't resist it any more. The third way is challenge it based on old-fashioned forgery, which does still occur.
