What actions give rise to liability for a bar tavern or liquor store in a dram shop action...

There are two limited circumstances which may give rise to liability against a bar or establishment that serves liquor. The first one involves willfully serving a habitual drunkard, somebody that the bar or establishment knows is a regular at the bar, regularly gets drunk, and on that occasion got drunk at the bar and then caused an accident. The second situation involves willfully serving alcohol to somebody that's under the age of 21, or that's a minor. The bar is not presented with fake identification from the person purchasing the alcohol and that person consumes the alcohol and then gets involved in the accident, that may give rise in liability against the bar.
